MEDIATION
Mediation is a process whereby a neutral and impartial third person acts to encourage and facilitate the resolution of a dispute without prescribing what it should be. It is an informal and non-adversarial process intended to help disputing parties reach a mutually acceptable agreement (Rule 10.210).
Do you want a mediator who is neutral and impartial?
Donna Lugar has the practical experience of more than 18 years of trial practice as a civil trial lawyer (Board Certified in 1999). She has devoted 100% of her professional time to alternative dispute resolution since 2010. You will be comfortable knowing that your mediator is not a practicing lawyer whom you may one day face in a case opposite you and your client.
Do you want a mediator who acts to encourage and facilitate the resolution of your dispute?
Donna works hard to resolve cases at mediation. She brings over 30 years of experience to the table to offer creative and case-sensitive resolutions to meet the parties’ needs. Should the case not be resolved at mediation for any reason, at your request Donna will continue to work with the lawyers/parties post-mediation, without charge, to get a case settled.
ARBITRATION
Arbitration is a more formal dispute resolution process where an arbitrator listens to the arguments and evidence presented by each side and then makes a decision. Arbitrations are popular in certain venues in both binding and non-binding formats.
Donna carefully reviews pre-arbitration submissions, receives and listens to evidence and arguments presented at arbitration, and then renders a fair and impartial written decision. The written decision typically contains an analysis of facts and any applicable law so that it is easily understood by the parties.
Arbitrations are conducted in the most timely and cost-efficient manner possible, and written decisions will be delivered timely.
